Legal Waiver and Acceptance of Conditions of Use
For Educational Purposes Only
The App ("Am I Drunk") is intended for educational purposes only and should not be relied upon for any other purpose, including but not limited to determining whether it is safe to drive.
Educational Tool
One main purpose for the development of this App is to educate users about the absorption of alcohol into their body and to help them understand how much alcohol may be in their body after consuming alcoholic beverages. People often underestimate the level of alcohol in their body and mistakenly believe they are sober when they are actually still over the legal alcohol limits. This App provides a reasonable estimation of how much alcohol is in your body based upon the consumption information the user inputs. However, it is not necessarily 100% accurate. The point of this App is to give the user a general idea of their alcohol level for educational purposes only. It is for the user to determine future actions based upon this information, and it is their sole legal responsibility.
Estimate Only
This App is designed to make users aware of the possible level of alcohol in their body (Blood Alcohol Concentration, BAC). This App calculates a reasonable guestimate based upon a tested industry-wide maths formula for calculating BAC. However, it is not as accurate as a breathalyzer and should not be used as a substitute for one.
Sobering Up
Users of this App may get a BAC estimate and then try to calculate the time it will take for their BAC to be lower and therefore safe to drive. This is extremely erroneous reasoning. Many factors, including body type, weight, sex, metabolism, liver function, food consumption, and enzymes, are involved in lowering BAC (sobering up). Your body may still be releasing alcohol into your bloodstream even if time has passed since your last drink. Eating food may slow down the absorption of alcohol, but this means it is still being released into your body, and you may still be over the legal alcohol limit. Lowering BAC and sobering up is medically complex. Any decisions by the user to drive after consuming alcohol are solely the responsibility of the user/driver.
Inherent Risk
There is an inherent risk of driving, working on machinery, with any amount of alcohol in your body. Any alcohol can impair driving skills and decision-making, potentially leading to a motor vehicle accident. Any accidents due to this are totally the driver’s responsibility.
No Liability
The App, its company, owners, and creators clearly make user aware that there is an inherent risk of driving with any amount of alcohol in your body. Any alcohol can impair driving skills and decision-making, potentially leading to a motor vehicle accident. Any accidents due to this are totally the driver’s responsibility, the App developer do not accept any legal liability if a user of the App drives when they have any alcohol in their body. Any consequential outcomes from driving with alcohol in your body, such as loss of license, loss of income, fines or time in prison, legal expenses, injury to themselves or other parties (including psychological or mental illnesses) and property is totally the App user’s sole legal responsibility.
Transport Alternative Choices
If the user of the App thinks they have alcohol in their body they should seek alternative transport. That is not drive themselves home. They should seek alternative transport such as Ubers, Taxi, Public Transport and if necessary walking. This action avoids the user from being involved in a motor vehicle accident and possibly being liable.
